1. Agreement to Terms

By accessing and using bushwalk.africa (the "Website") or purchasing any products or services from Bushwalk (Pty) Ltd ("Bushwalk," "we," "us," or "our"), you agree to be bound by these Terms of Service and all applicable laws and regulations.

2. Use of Services

Eligibility

You must be at least 18 years old to make a booking or purchase. By using our services, you represent that you meet this requirement.

Account Responsibility

• You are responsible for maintaining the confidentiality of your account credentials
• You agree to provide accurate and complete information
• You are responsible for all activities under your account

3. Booking and Reservations

Safari and Tour Bookings

• All bookings are subject to availability
• A deposit is required to confirm your booking
• Full payment is due according to the payment schedule provided
• Prices are quoted in South African Rand (ZAR) unless otherwise stated
• Prices are subject to change until booking is confirmed and deposit received

Product Orders

• Orders are subject to product availability
• We reserve the right to limit quantities
• Prices include VAT unless otherwise stated
• Product images are for illustration purposes and may vary slightly

4. Payment Terms

• We accept payment via PayFast (credit/debit cards, EFT)
• All payments are processed securely through our payment gateway
• Payment confirmation will be sent via email
• Currency conversion fees may apply for international payments

Safari and Tour Cancellations

• More than 60 days before departure: 90% refund
• 30-60 days before departure: 50% refund
• Less than 30 days before departure: No refund
• Cancellation fees may apply
• Some experiences may have different cancellation policies

6. Travel Insurance

We strongly recommend purchasing comprehensive travel insurance covering:

• Trip cancellation and interruption
• Medical expenses and emergency evacuation
• Lost or delayed baggage
• Personal liability

Bushwalk is not responsible for costs related to illness, injury, or other unforeseen circumstances.

7. Health and Safety

Medical Requirements

• Clients must disclose any medical conditions that may affect participation
• Yellow fever vaccination certificates may be required for certain destinations
• Malaria prophylaxis is recommended for some areas
• Clients must obtain necessary vaccinations and medications

Assumption of Risk

Safari and outdoor activities involve inherent risks. By participating, you acknowledge these risks and assume responsibility for your safety. We recommend following all safety instructions provided by guides.

8. Intellectual Property

All content on this Website, including text, graphics, logos, images, and software, is the property of Bushwalk (Pty) Ltd and protected by copyright laws. You may not reproduce, distribute, or create derivative works without our written permission.

9. User Content

By submitting reviews, photos, or other content, you grant Bushwalk a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content for marketing and promotional purposes.

10. Limitation of Liability

To the maximum extent permitted by law, Bushwalk shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits or revenue
• Acts of God, natural disasters, or force majeure events
• Actions of third-party service providers
• Theft, loss, or damage to personal belongings

You agree to indemnify and hold Bushwalk harmless from any claims, damages, or expenses arising from your use of our services or violation of these Terms.

12. Force Majeure

Bushwalk is not liable for failure to perform due to circumstances beyond our control, including but not limited to natural disasters, war, terrorism, pandemics, or government restrictions.

13. Changes to Itineraries

We reserve the right to modify itineraries due to weather, safety concerns, or other unforeseen circumstances. We will provide suitable alternatives when possible.

15. Governing Law

These Terms are governed by the laws of South Africa. Any disputes shall be subject to the exclusive jurisdiction of South African courts.
